2. Data Collected and Purpose
The personal data requested through the website forms and the purchase process are used for the following purposes:
- Sessions and Stand-ins form: Handling and assessing professional proposals for gigs, recordings or collaborations.
- General Contact form: Answering enquiries, questions about «El Secreto del Groove», press or technical support.
- Purchases in the shop (shop.guillermotemino.com): Order management, payment, delivery of the digital file, invoicing and compliance with tax obligations. Name, email, billing address and order details are processed. Card or payment account data is processed directly by the payment gateway chosen by the buyer.
Newsletter and commercial communications. If you tick the optional checkbox “Subscribe to our newsletter” when placing an order, we will process your email address, and any other data needed to send it, to send you commercial communications and news from Guille Drums. The legal basis is your consent (Article 6.1(a) GDPR). Ticking the box is not a condition of purchase. We will keep this data until you withdraw your consent. You can withdraw it at any time by writing to guillermo@guillermotemino.com. We use the Hostinger Reach service for this mailing, which acts as a data processor. If you do not tick the box, you will not receive these communications.
3. Legal Basis for Processing
The legal basis for processing data submitted through the forms is the user’s express consent, given by ticking the acceptance box and submitting the form, as well as the application of pre-contractual measures at the data subject’s request. For purchases, the legal basis is the performance of the sales contract (Art. 6.1.b GDPR) and compliance with legal invoicing and tax obligations (Art. 6.1.c GDPR).
4. Data Retention
Form data will be kept for as long as strictly necessary to respond to the request made, or until the data subject requests erasure, always respecting the legal limitation periods. Order and invoicing data will be kept for the periods required by the applicable tax and commercial regulations.
5. Recipients and Data Processors
For the proper operation of the website and the shop, the following service providers are used, acting under GDPR-compliant agreements:
- Hostinger: web hosting provider for the website and the shop.
- Payment gateways (Stripe, WooPayments by Automattic or PayPal, depending on the method chosen by the buyer): process the payment and payment data under their own privacy policy.
- Formspree Inc.: provider for receiving and technically processing forms via API and forwarding them by email.
International transfers: Formspree Inc. hosts its services on Amazon Web Services in the United States, so data submitted through the forms is transferred outside the European Economic Area. This transfer relies on the Standard Contractual Clauses approved by the European Commission (Article 46(2)(c) GDPR), on which Formspree relies as a data processor. When any of the payment gateways processes data outside the European Economic Area, it does so with the safeguards provided for in the GDPR, which each provider details in its own privacy policy.
6. Cookies and similar technologies
This website (guillermotemino.com) does not use its own analytics or advertising cookies. YouTube videos only load when the user chooses to play them, through the youtube-nocookie.com domain, and from that moment YouTube may store data in the browser. The shop (shop.guillermotemino.com) uses strictly necessary WooCommerce technical cookies to remember the cart and the checkout session, and the payment gateways (Stripe, PayPal) may use their own cookies or technologies needed to process the payment and prevent fraud. These technical cookies do not require prior consent. If analytics or advertising tools are added in the future, consent will be requested before activating them and this policy will be updated. Users can delete or block cookies in their browser settings.
7. User Rights
Users may at any time exercise their rights of access, rectification, erasure, restriction of processing, data portability and objection by sending a written request to guillermo@guillermotemino.com, with the subject line “Data Protection” and proof of identity. If you consider that the processing does not comply with current regulations, you have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD).
